Official Rules
The following rules and regulations apply to the Review to Win Sweepstakes on: bonton.com, bergners.com, bostonstore.com, carsons.com, elder-beerman.com, herbergers.com and younkers.com as sponsored by The Bon-Ton Stores, Inc. One (1) prize will be awarded (between all online stores) for the month of November 2009.

Contest Period: The Sweepstakes begins at 12:01 a.m. EDT on 11/15/09 and ends at 11:59 p.m. EST on 11/30/09 for the October drawing.
Eligibility: No purchase necessary. The Sweepstakes is open only to legal residents of the contiguous United States and the District of Columbia who are 18 years of age or older as of the date of entry. Employees, officers and directors of The Bon-Ton Stores, Inc. (the “Sponsor”), its subsidiaries, affiliated retailers, promotion suppliers and advertising agencies, the spouses of such persons and the I.R.S. listed dependents or members of such person’s household are not eligible to enter or win any prize. The Sweepstakes is void in Puerto Rico and where prohibited.
How to Enter: You can enter the Sweepstakes by using either one of the following methods:
On-line Entry: Register for the contest by submitting a complete product review online at bonton.com, bergners.com, bostonstore.com, carsons.com, elder-beerman.com, herbergers.com or younkers.com. Online entry requires user to create a free user account on any one of the websites listed. One valid and complete product review equals one contest entry. Completed and approved reviews will appear on all seven (7) websites. Multiple reviews of the same product are not valid. "SPAM" or fraudulent reviews will not be posted and all entries from said user will be void. The Sponsor reserves the right to reject any reviews it deems inappropriate or unsuitable. Registering and submitting a review will not increase your chances of winning.
All online entrants must have a valid email address.
Mail Entry: On a 3x5” postcard, handprint your first name, last name, address, telephone number, birth date and email address (if any), and mail to: “Review to Win Sweepstakes”, The Bon-Ton Stores, Inc., 331 West Wisconsin Ave., Milwaukee, WI 53203. All mail entries must be postmarked by end date of each contest period and received by 12/7/2009 drawing for eligibility. All entries submitted become the sole property of the Sponsor and will not be returned.
Winner Selection and Notification: One (1) winner per month for all seven (7) Bon-Ton Stores, Inc. nameplates will be selected. Winners will be selected by random drawing from among all eligible entries at least two weeks of the contest end date. The potential winners will be notified by mail, email and/or telephone. If a potential winner cannot be contacted or does not respond within five (5) days from the first attempt to notify him or her, and/or the prize or prize notification is returned as undeliverable, such potential winner forfeits all rights to win the Sweepstakes or receive the prize, and an alternate potential winner will be selected. Upon contacting a potential winner and determining that he or she has met all eligibility requirements of the Sweepstakes, including without limitation the execution of required waivers, publicity and liability releases and disclaimers, such individual will be declared a “Winner” of the Sweepstakes. All decisions of the judges are final.
Prize Description: One prize will be awarded each month. Each prize consists solely of the prize advertised for that month’s sweepstakes.
Prize winners must sign and return an affidavit of eligibility and publicity/liability release within fifteen (15) days of notification and return to: The Bon-Ton Stores, Inc., 331 West Wisconsin Avenue, Milwaukee, Wisconsin 53203, Attn: Review to Win Sweepstakes. The Sponsor reserves the right to select an alternate winner and original potential Prize Winner will forfeit the prize. In the event of noncompliance with this or any other requirement, winner will be disqualified.
Prize Value: The approximate retail value of each prize is as stated in that month’s sweepstake.
Taxes: All fees, federal, state and other taxes, costs and expenses relating to the use, acceptance and possession of the prize are the sole responsibility of the winner.
Odds of Winning: Odds of winning depend on the number of eligible entries received.
No Prize Transfer or Substitution: No substitution, exchange or transfer of prize except by The Bon-Ton Stores, Inc. in which case a prize of equal or greater value will be substituted.
Consent and Release: By participating, entrants agree to comply with these Rules. Entrants are solely responsible for their own actions and agree to hold harmless the Sponsor and its subsidiaries, divisions and related companies and the officers, directors, employees, agents, successors, assigns and licensees of each from any liability for losses, damages or injuries arising in connection with their participation in the Sweepstakes or the award or use of the prize. Acceptance of prize constitutes consent to use winner’s name, address (city only) and likeness for editorial, advertising, publicity and television broadcast purposes without further compensation or permission, except where prohibited.
Disclaimers: The Sponsor is not responsible for entries that are lost, deficient or incompletely received for any reason and is also is not responsible for any typographical or other errors in offer, administration of the award or in the announcement of the prize.
The Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of a website. Use of any automated process to enter is prohibited and may result in disqualification.
The Sponsor reserves the right to cancel, terminate or modify the Sweepstakes if it is not capable of completion as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, force majeure or technical failures of any sort.
The Sponsor is not responsible for computer system, hardware, software or program malfunction or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by the person in whose name the email account is registered.
The Sponsor is also not responsible for errors in the administration or fulfillment of this Sweepstakes, including without limitation mechanical, human, printing, distribution or production errors, and may modify or cancel this Sweepstakes based upon such error at its sole discretion without liability.
THE SPONSOR MAKES NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, AS REGARDS TO THIS SWEEPSTAKES OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY PRIZE OR ANY COMPONENT OF ANY PRIZE. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE A WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. If an email address is provided on entry form, entrant acknowledges that he or she: (1) is over the age of 18; and (2) has read the privacy policy on the Sponsor’s websites (http://www.bonton.com/category/customer+service/privacy+policy.do).
Applicable Laws and Jurisdiction: This Sweepstakes is subject to all applicable federal, state and local laws, and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of Wisconsin without regard to its choice of law provisions. All disputes arising out of or connected with this Sweepstakes will be resolved individually, and without resort to class action, exclusively by a state or federal court located in Milwaukee, Wisconsin. Should there be a conflict between the laws of the State of Wisconsin and any other laws, the conflict will be resolved in favor of the laws of the State of Wisconsin. All judgments or awards shall be limited to actual out-of-pocket damages (excluding attorney’s fees) associated with participation in this Sweepstakes and shall not include any indirect, punitive, incidental and/or consequential damages.
